Mediation and arbitration expert course

Starting from the base that when there is a conflict there is a confrontation, a shock, a struggle between the parties involved in the initial disagreement, it is necessary, to know and possess the necessary skills to carry out the management of these conflicts with an impact on the control of stress and emotions in these situations. Arbitration and mediation are alternative methods to the judicial litigation that allow, with the help of a third party, to seek a safe solution, in time and cost reduced, and that allows to take into account additional aspects and interests of the parties and create options that in the courts would not be taken into account, all confidentially, maintaining or even increasing commercial relations and, above all, preserving control over the final resolution of the conflict.

- Offer in an introductory way the national and international aspect of arbitration. - Analyze the different modalities of arbitration agreement, the requirements that must be and the content of the same. - Know in depth the arbitration procedure as a guarantee of all arbitration. - Do a study of the foundations of mediation as a method of management and dispute solution. - Understand mediation in civil and commercial matters, knowing their procedures, execution systems as well as the different frameworks of mediation in civil and commercial matters. - Acquire knowledge about the mediator functions, as well as the processes, clauses and mediation agreements. - Manage conflicts, solve problems and make technical negotiation decisions to resolve conflicts. - Attending professional deontology with a detailed analysis of the mediator ethical code.

Today, labor, personal, business relations or all those that suppose an interaction between people, give rise to the emergence of conflicts between them. In this training you will know two of the extrajudicial systems of conflict resolution such as arbitration and mediation facilitating the student based on practical examples. Conflicts will be discussed from a practical point of view with the intention of knowing how to face a situation in which the parties prefer not to go to courts in the first instance. In the expert course in arbitration and mediation, it will be terminated to learn to channel conflicts through these two systems, on an ethical, legal and moral basis preparing it for the mediator function or to be part of the body of referees.
